Don't Get Caught in the Impact Zone. By Dan Polimino.

Over the Holidays, I was vacationing in Hawaii and if you have ever been to Hawaii in the winter, you know that you can expect some great swells. The North Shore of Oahu is famous for their 20-foot swells in the winter. I was on the Big Island where the waves are much smaller and that was a good thing because I am far from being a pro when it comes to boogie boarding or surfing. Nonetheless, I wanted to teach my son and daughter to boogie board so we headed out to tackle the waves. While they did great, I, on the other hand had my fair share of wipeouts. Boarding or surfing is one of those sports that you need to practice week in and week out. It had been a while since I boogie boarded last, and boy did it show.

More than once, I found myself caught in the impact zone. That's the area where the waves close out and crash directly on you. Even though I know how to duck under massive surf, I still got caught a few times, getting rolled by waves. The problem was my INDECISION. Many times I would be in the impact zone and I knew that I should either be farther out before the waves closed out, or I should be farther in, close to shore. It was my lack of making a smart, quick decision that often got me hurt. Each time I stumbled back to shore with a hurt knee, shoulder, foot, or back. I was painfully aware that I was 43 and getting older by the minute. I realized that my indecision was hurting me.

How many of us can say that in our daily life? Our indecision may be hurting us! Maybe we keep finding ourselves in the impact zone because we have not made a decision to go forward or back. In real estate, this may mean it's time to sell that house and move on to a new chapter in your life. It may mean making rental homes a new business for you. Or for someone thinking of buying, maybe the family has outgrown the house and it is time to move up. You’ve been indecisive long enough; you're in the impact zone, so either move out before the waves crash, or move in safe to shore. Sometimes, the most uncomfortable place to be is in your comfort zone.

I love how long the runs are. And i love how each level of slopes are in almost separate area. Like the greens are mostly in the base, the blues are mostly on the base of Peak 7, while the upper Peak 7 and 10 are the blacks, so when you are on the blues/greens, you won't be afraid that you would "slip" into the blacks... My goal next year is to conquer the peak 10 :) this is def. a place for both beginners and advance skiers."

Mina from Los Angeles, CA says, "Breckenridge was a divinely beautiful place to snowboard. I went for 2 full days last weekend, and loved every minute of it! Peak 10 is pretty amazing, with the black-blue runs in the beginning, mellowing out to the wide-open blues. Lines can get pretty long during peak season, but not so bad as the socal resorts. Prices are hefty. $110 for a full day, $220 for 2 days, you don't get a price break unless you buy more than 2 days at a time. You can buy cheaper tickets online, but MUST be at least 7 days in advance. (Wish we knew that). The town is very fun and lively, many restaurants/bars to keep you entertained at night. We also encountered several locals, who were extremely friendly and accommodating to us 'tourists'. Many beautiful luxury cabin rentals in the area. If you're from southern CA and want to get away, and also get some AWESOME snowboarding/ skiing in, go to Breck! (If you're unconvinced, we saw Shaun White and some other pros practicing in the terrain park here!)"

Refinancing a condo could be easier than you think!

While obtaining a mortgage to purchase a condominium may present an interesting challenge because of the required project approval on the Home Owners Association (HOA), refinancing a condo could be easier than you would think.

If you have an existing government loan, either FHA or VA, project approval is not required for either a Federal Housing Administration (FHA) "streamline" refinance or VA Internal Rate Reduction Refinancing Loan (IRRRL). Both loans are designed to help people refinance to either a lower interest rate or change from an Adjustable Rate Mortgage (ARM) to a fixed rate mortgage. These loans do not allow for taking cash out. While both FHA and VA mortgages do have programs to provide for cash out, the standards are higher, and will include project approval and other criteria such as an appraisal, full income documentation, etc.

In addition to not requiring project approval for a VA or FHA rate reduction refinance, an appraisal is usually not required. Credit score requirements are reasonable, and debt to income ratios are not a factor in qualifying. In most mortgages, closing costs may be rolled into the new mortgage. A caveat I must mention is that borrowers should closely examine how much is being rolled into the loan. I have seen predatory lenders roll costs into a mortgage that would take the borrower over 15 years to recapture. The borrowers were so focused on rate that they forgot that the interest rate is only half of the equation. Rate and fees are what counts.

It's Worth Repeating. By Dan Polimino.

As you know, I have sold luxury homes for some time now and I frequently get calls from frustrated sellers who are having a tough time selling their property. I understand their frustration; it's not been easy for the Realtors either over the last three to four years. Most people start off the conversation with the same question, which is, "Why can't we even get an offer on our home?" The answer is one that I have written about many times before, but I think it is worth repeating. People like to make the real estate business really complicated, but the truth is, it boils down to just four main reasons why your home may not be selling. Here they are again in order of priority:

* Did you price it right? All a realtor can do is present the data. It's your home, and you make the decision on how quickly you want to sell the home. If you ignore good data and price it high, the home will sit, sit, and sit. When you decide to price it right, the home will sell, but the decision is entirely up to you. Don't get caught in hopa, hopa land. Hoping that someone will magically come off the street and over pay for your home.
* Does the home show well? If it does show well then cross this off the list. If you are not sure, ask your agent. If you want an outsider’s point of view, have a friend walk through your home with a critical eye giving you feedback or hire a stager.
* Do you have great marketing? This is easier than you think. You are smart people and through the process of interviewing agents, you will know great marketing when you see it.
* Location, location, location. It's the first and most important rule of real estate. If you have a bad location or a challenging location, you may have a hard time selling that home. The only thing that you can do to combat a tough location is to price the home well below market value. You have to make the price so appealing that a buyer would ignore the location because the price is so darn good.

Finally, if you don't get all of the above absolutely spot on, then you will have a miserable time attracting offers. Remember that the goal is to sell it as quickly as possible for the highest price. That means getting these four points CORRECT right out of the gate.

Also, I attended all the films during the Feast Fest last month, and they were all fantastic. I loved the commentary that accompanied each show. The Clyfford Still doc included the film-makers and museum director for an hour-long Q&A session afterwards, which really enhanced the film. Entertaining, enlightening, and instructional ... all at once!"

Purchasing a condo that is not FHA approved

In the Denver metro area a trend, that is further depressing home sales, is the increased standards required for a condominium project to have Federal Housing Administration (FHA) approval. Thankfully, these standards do not currently apply to townhomes. Astute real estate agents will verify the exact status of what appears to be a townhome, however some townhomes have a condo legal description which makes it fall under FHA rules for a condo. Not a good situation to see a buyer pay for an inspection and appraisal, then find out that the buyer is approved, but the property is not.

One recent study showed that only one third of the condominium developments in the Denver area were eligible for FHA financing because of the more stringent requirements. In Commerce City the situation is even more depressing, with only one out of fourteen condo developments being approved. As FHA financing is by far the most common option for buyers under $200,000, this presents a real challenge for sellers.

We should remember that if FHA financing is not an option, buyers have other choices such as VA loans, conventional mortgages, AND portfolio products. While VA and FHA mortgages are both government loans, the standards for FHA condominium projects are much higher than for VA loans. Keep in mind that because a project is not FHA approved does not always mean it is ineligible for VA financing. Portfolio products are mortgages that a lender keeps in their own portfolio and do not sell on the secondary market. Hence the lender has more flexibility in designing qualification standards. Portfolio products, in most cases, will have higher borrower standards such as credit score, down payment, etc, but they are a viable option.

Look Who Is Selling. By Dan Polimino.

When I am out showing homes to buyers, you can start to get a feel of what's going on in each home that you visit. The feeling you get more than anything else these days is one word...DIVORCE!

As a seasoned real estate agent, I can pick this out from a mile away and so can most people. The first thing you notice is that the home only has about half of the furniture in it. It looks sparse like there should be more furniture in each room. In the closet, there is just one set of clothes and the kids' rooms sometimes look like they have not been lived in for a while. Every time I see this, it breaks my heart and I see it more and more every day. I can honestly tell you that for every 10 homes I show, eight of them are divorce situation. It seems as though the problem has really escalated in the last four years and I can understand why.

When things go south with the economy, jobs are affected. That's a ripple effect and people have a hard time paying their bills, staying in their homes, and yes, keeping their marriages. Financial strain is easily the number one killer of all marriages. People see foreclosures stats on TV all the time about the housing market, but I think we all need to keep in mind that there was a family that lived in that foreclosed home. Now, more and more of those families are divorced families.

I have a tremendous amount of empathy for people in this situation since I am the son of divorced parents at the early age of five. I had a tough time dealing with this growing up and spent my fair share of time in counseling as an adult. I can tell you from my own personal experience that the children of divorced parents suffer the most. I have been married now for over 11 years and while it is never easy, I try to do my best to keep our marriage strong. I still live with the pain from losing my childhood.

When I first got into the business, I heard a few Realtors talking about going after the divorce market because you got two sales out of it. They obviously never felt the pain. I hope I never have to sell another home of parents getting divorced, but I know it's not reality. I just wanted all of you to know how bad the problem is and it's getting worse.

Using a reverse mortgage for a divorce

An unfortunate trend that we are seeing is mature couples getting a divorce. Sometimes the remaining spouse takes out a new mortgage to payoff the departing spouse for their equity or agrees to make the monthly payments. The problem is that many mature people do not have the necessary income, etc. to obtain a new mortgage or the ability to live comfortably after they make the mortgage payment. When you consider selling in a down market, costs associated with selling and moving, etc, a Home Equity Conversion Mortgage (HECM) could be a good option.

A HECM is usually utilized as a refinance option to help people, over 62, who have substantial equity in their home live better. More commonly known as a reverse mortgage, it may also be the best option for a couple that is divorcing. The remaining spouse keeps the home and will only have to pay property taxes and hazard insurance. The departing spouse can receive cash for their equity to help them get a fresh start and not be encumbered with a mortgage payment for a property they no longer occupy.

All in all, this a win-win option for people in a sad situation. As always, your mortgage professional should take the time to see what mortgage option is best for your unique personal situation.

They May Change the Game at the Last Minute. By Dan Polimino.

A house is listed with me and my business partner Gary Lohrman. It's under contract; everything is moving along smoothly, we are past inspection, appraisal, and all the big contingencies. We are just a few days away from closing when the buyer's agent calls to say that there is a problem. At the last minute, the lender has decided that 20% down is not going to be enough and they will not close the loan unless the buyer comes up with 30% down. Now mind you, these buyers have a pre-approval letter from the lender, have acted in good faith, and provided all documentation that the lender has asked for. They are well qualified with high credit scores and good jobs but without reason or cause, the underwriter decides to change the game at the last minute. Let's take a look at the bind that everyone now finds himself or herself in:

• The Sellers are just a few days away from selling their home and moving on with their lives. Now they are faced with the possibility of having to put their home back on the market again to do it all over. Not to mention their property has been off the market with no showings for 30 days.
• The buyers have packed up their stuff, are ready to move, have paid for inspections and appraisal, plus additional out of pocket expense. They are also under contract and may be in jeopardy of losing their earnest money.
• The Realtors have done their job and worked hard for the last 30 days or more and are now faced with not getting paid.

The question is, "Why were these people qualified for this loan by the lender with 20% down (by the way 20% down is usually a safe bet and not a high risk loan) just 25 days ago and now a few days before closing, the lender wants 30% down?" The lender is holding everyone hostage with a game called "pay up or you won’t close." The answer is that the underwriter who signs off on the file sees something they don't like and they think that an extra 10% percent down will resolve the risk. Truth is, the extra 10% in no way diminishes the risk. This is an underwriter trying to protect his or her hide in the event that the loan defaults.

I wouldn't be writing about this if it just happened once, but it happened three times, all in a span of 45 days in November and December. It happened on three different properties, with three different lenders and three different buyers/sellers. It could happen to you, so beware. This time, the sequel is better than the original

Rarely is a movie sequel better than the original. I feared that HARP II (Home Affordable Refinance Program) would be another empty "cotton candy" promise from Washington with a lot of fluff and no substance. I am happy to see that I was wrong. Recent verified results are making me a lot more optimistic about this program to help homeowners and INVESTORS, who owe more than the property is worth and have been unable to refinance in the past.

Property owners may go to www.fanniemae.com to see if their property is eligible. At present, this program is only for conventional loans, and not for FHA or VA. If a property owner has a FHA or VA mortgage, it is worth checking to see if they qualify for a streamline refinance. FHA and VA streamline loans are characterized by relaxed standards that exhibit a lot of common sense that I though was gone from the mortgage industry. I recently witnessed an individual close two loans under the HARP II program for his primary residence and rental property. There were no upfront fees for an application or appraisal, and the customer service was first rate.

I was pleasantly surprised to see that HARP II may used for investment properties. Normally, property owners will let a rental property go into default instead of their primary residence. While I am not in favor of government funded bailouts for the fat cats, almost everyone involved in a foreclosure is damaged. Not usually mentioned are renters who are displaced and have to find a new place to live in a tight rental market. In some parts of the country it is easier to qualify for a mortgage than it is to rent a property. Hopefully, letting investors benefit from HARP II will result in fewer displaced renters.
